Jury Awards $15 Million in Title IX Violation Case

An orthopaedic surgeon has settled a years-long gender-discrimination case with Philadelphia-based Thomas Jefferson University, The Philadelphia Inquirer reported May 16. Terms of the settlement were not disclosed, ending a legal dispute that began in 2018 after Dr. John Abraham sued the university over its investigation into misconduct allegations against him.

Incident and Allegations

Dr. Abraham, who lost his clinical privileges and faculty appointment, alleged that in June 2018, a “sexually aggressive” resident physician at TJUH coerced him into a sexual encounter at his home, despite his intoxication and lack of consent. Three days later, the resident and her husband attempted to extort money from him, prompting Dr. Abraham to report the misconduct and extortion.

Retaliatory Counter-Complaint

The resident then filed a counter-complaint alleging nonconsensual intercourse, which Dr. Abraham claimed was retaliatory. He asserted that the university coerced him into taking a leave of absence, failed to investigate his allegations, ignored potential retaliation by the resident, and overlooked exculpatory evidence, including a threatening voicemail from the resident’s husband.

Jury Decision and Verdict

The jury, after deliberating for two and a half hours, considered the harm to Dr. Abraham’s career, reputation, and potential earnings before reaching their decision on December 11. He was awarded $15 million in a 2023 verdict, which was the largest-ever under Title IX at the time. However, in March, that award was voided.

University Response and Settlement

In response to the initial verdict, Jefferson Health expressed disappointment and planned to appeal, maintaining that both parties were treated fairly. An attorney for Thomas Jefferson University did not immediately respond to a request for comment from The Inquirer.
